State - Identity - Law Divisions in the current political ethical debate

Abstract
The migrant crisis has laid already existing divisions within social ethics open. Social ethics is more and more concerned with society while ethical issues of the state are overlooked. The new political ethics increasingly uses virtueethical terms as categories of normative ethics. The consequences of this change in perspective are a normative individualism. In light of these developments in social ethics, this article highlights the necessary legal function of the state as the basis for a human community with respect for human rights. Here, social ethical and legal standpoints and approaches are combined to investigate this issue.
